Due to the passage of Act 43 in 2017, consumer grade fireworks such as firecrackers, roman candles, bottle rockets, and similar aerial fireworks that contain a maximum of 50 milligrams of explosive material, are legal in Pennsylvania. However, there are restrictions on where and how they can be used. According to state law, only a person who is at least 18 years of age may purchase, possess, and use consumer fireworks. The following use of consumer fireworks are also prohibited:
• Intentionally igniting or discharging consumer fireworks on public or private property without the express permission of the owner
• Cannot be discharged from or within a motor vehicle or building
• They cannot be discharged toward a motor vehicle or building
• They cannot be discharged within 150 feet of an occupied structure (regardless of whether or not a person is actually present within)
• They cannot be discharged by a person under the influence of alcohol, a controlled substance, or another drug

A person using consumer fireworks in violation of state law commits a summary offense and, upon conviction, can face a fine of up to $100.
It’s important to remember that although fireworks may be entertaining for some, they can be traumatizing to others. Please be courteous to your neighbors and celebrate safely this 4th.
