Cranston Man Charged With Drunken Driving

Matthew S. Biagioni, 20, of 34 Hersey Road, Cranston, was arrested at about 2:31 a.m. on Nov. 3 and charged with drunken driving, and cited for refusing to submit to a chemical test. According to online records, Biagioni is a student at the University of Rhode Island.

According to police, an officer traveling behind a tan Ford Taurus driven by Biagioni on Kingstown Road near Old Mountain Field saw the car swerving. A traffic stop was made near Columbia Street.

Police said Biagioni smelled strongly of alcohol, but he denied drinking. When they asked him to perform field sobriety tests, police said Biagioni initially refused to, because he was worried about jeopardizing his probation from jumping a subway gate in New York City. He instead asked police to just follow him home as he drove, and when they refused, he submitted to field sobriety tests.

According to police, Biagioni failed field sobriety tests, which he told police was due to it being “too cold” outside. He was arrested at this point.

Police said that during processing at headquarters, Biagioni refused to answer questions, or to even sign the “refuse” line on the chemical breath test, which meant it was an automatic refusal.

Police noted that Biagioni became hysterical and started crying at one point, before calming down and finishing the booking process. Police said he asked for and received permission to use the bathroom, but noted that he left the door open and urinated on the floor instead of in the bowl.

According to police, Biagioni was processed and then released at about 4 a.m.
