Smyrna Mom Alleges Son Sexually Assaulted At YMCA Program
A Smyrna mom is suing the YMCA, saying it failed to protect her kindergartner from a sexual assault during an after-school program.

SMYRNA, TN -- A Smyrna woman told WSMV she is suing the YMCA after her son was sexually assaulted by another student during an after-school program.
The mom told the station her kindergartner was participating in the YMCA's Fun Company program at Cedar Grove Elementary and she found out about the alleged assault earlier this month.
"He just told me that a boy in the school, and he told me his name, was making him put his mouth on his private parts when he was in the bathroom," the mother, who wanted to remain anonymous, told the station.

According to the lawsuit, the other child had a history of inappropriate contact and was not supposed to be in the bathroom unsupervised with other students.
"For one, they failed my client [because] they allowed him to go into the restroom with another child, unsupervised, and that child was known to be a behavior problem," attorney Ali Toll told WSMV. "He was known to act inappropriately and inappropriately touch other children."

The YMCA told Channel 4 it had yet to be served with the lawsuit so could provide a full response, but did say safety of children is important to the organization.
