According to a criminal complaint filed in Milwaukee county, when the officers asked Ferguson to get out of the car, he refused. After several more tries, officers just couldn't get him to come out of the car. Instead, Ferguson shifted his rental vehicle into drive and took off heading north on Port Washington Road.

Police began to pursue Ferguson, who weaved in and out of traffic to enter southbound I-43, where he reached speeds over between 115-120 miles per hour. Ferguson exited I-43 at Atkinson and lost control as his vehicle hit a sidewalk. He continued south, losing control and striking a Milwaukee County bus at North 8th St. and W. Atkinson Rd., according to the criminal complaint.
