HOA Board doesn't respond to questions

Surprise, surprise.

If you've asked your board president or management company questions, you likely realized that they will not answer the phone, door or emails. As a matter of interest, should you press for an answer, the only response you might get is from a process server.

These volunteers wanted your vote. Now that they have the power, they can and will ignore you. Mobster attorney Randy Cohn carefully crafted Governing Documents so that BofD's are not required to answer questions. It never makes sense to a Board to address the problem head on. Instead everything festers until it's turned over to an attorney.

If you think you are alone you are not. Unresponsive Boards operate behind the iron curtain of inaccessibility. This leads to apathy and eventual resentment. When they ignore you don't vote for them. Ignoring a Member is psychological warfare and must be addressed as such.

When I get a response from Board Members they play the sympathy card ... We're just volunteers. In other words they were not conscripted, they wanted on the board. These volunteers come from diverse and well-educated backgrounds ... Philosophers, ministers, accountants, scientists, entrepreneurs, attorneys, realtors, nurses, teachers, pilots and engineers. These career paths are seemingly benign until they are influenced by the most tyrannical amongst them. Why would any Member think these people cannot understand Governing Documents? Does the insurer conclude the minute they become a board member they become stupid?

HOA Boards rely on member apathy in order to operate with minimal accountability. Without consistent member oversight, predictable problems may arise: Neglect of common areas, loss of records (hidden in garages), secret meetings (more than you know), selective enforcement, breach of fiduciary duty, misappropriation of funds (can't sue when there's no money), violation of State Statutes or Governing Documents, rigging of elections (more than you know), property seizures (over 12" flags, I kid you not), and fraud.

Your well intentioned scrutiny is essential. Once monitored, illegal and unethical HOA Board actions will be exposed and, ideally, eliminated. Sunshine is the best disinfectant. If you live in an HOA make it your work to scrutinize the Boards actions; not every volunteer needs to be on the Board. To any Board Member reading this, start talking to your Members, quit the power game.
