HOAs: Prisons Have Fewer Rules

Tyrants like the rules that control your life: the declarations that run 10-250 pages, ByLaws, Rules and Regulations, Enforcement Policy, and the list of fines, perhaps another 50+/- pages. Boards do not know or understand governing documents, but you must.

HOAs are not state actors and as such are not subject to constitutional constraints. There can be nothing close to carefree living when you are not protected by the American Constitution. Once you cross the red line into HOA life you are a subject to control. You've seen Community Manager, Morticia Addams 4" nails, used to climb trees and spot weeds. Little difference from prison guards. Boards have little incentive to roll back governing docs that allow them indulgence in rigid or arbitrary behavior. Developing rules for the sake of having rules, is unnecessary.

Outside an HOA when you have an issue with a property, you call the city/county. In an HOA its the opposite; the Member is constantly monitored by the MC, the board, and neighborhood comrades. It creates undue anxiety. You are a slave to your property; enjoying it less. Take a vacation, come home to not only one weed letter but three and find $300 in fines bc you failed to remove the tree that toppled in the wind storm when traveling. Fortunately boards cannot foreclose over fines (they used to). Outside that, every subjective decision about the exterior of your home is made by the tribunal controlled by Boris Badenov. There are no real standards only subjective ones. When Boris holds a grudge, your approval is delayed or never approved. Nurse Ratchett, a BofD lives w/dumpsters or trucks parked on her front lawn for years yet Boris never says a word. Living outside an HOA you think for yourself and act to benefit your most precious investment. THAT is carefree living.
