The Office of Administrative Hearings is available to Members of HOAs as a place to resolve HOA disputes. Members like this due to the low cost of filing. If they have a simple issue it’s intended to be a more relaxed alternative. The Rules of Evidence used by courts do not apply in administrative hearings.

If you feel you can represent yourself for the 6 weeds the HOA found in your yard, indeed you might be able to, but the HOA will bring in the high skilled lawyer designed to intimidate the Member. You can see we're not off to a good start.

As you would expect, you, representing yourself are required to swear under oath that you will tell the Truth. Later the Judge will tell you that the attorney is not held to the same standard, only his witnesses. SWEET! Further you can not ask your witnesses yes or no questions … those would be leading the witness. However mobster attorney Randy Cohn can ask you questions that result in a yes or no. And no, the Judge will not allow you to expand on your answer to make sure the truth is heard. Important, relevant details are often left out at the Members expense. They got you alright! These hearings cost the HOA insurer approximately $30K. Unfortunately, I can’t provide a link to verify that.

HOAs can't be fixed to ever be fair, friendly or equitable towards its members so lets consider some alternative strategies that will really make a difference. Tell your Realtor you want the lime green house that's not in the HOA. That's good for everyone. That's carefree living.
