DA Files Charge Related to Lucas Lipscomb Shooting

The father of a boy that was with Lipscomb when he was shot faces a weapon charge.

The father of a boy who was with a 17-year-old Poway boy when he apparently shot himself fatally was charged with criminal storage of a firearm, the District Attorney Office said Tuesday.

Kevin Brennick, 49, will be arraigned Oct. 16 in connection with the death of Luke Lipscomb.

Lipscomb was shot Nov. 4, 2011 in Brennick's home on Midland Road. The boy, a Poway High School junior, was shot between the eyes with a .22-caliber rifle and died at a hospital two weeks later.

The loaded rifle was left in Brennick's kitchen, investigators said. No adults were present at the time of the shooting.

District Attorney spokesman Steve Walker said a hearing is scheduled Oct. 18 in Juvenile Court related to the shooting. He would not say who the hearing involved and if either of the boys Lipscomb was with has been charged in the case.

According to court documents, Lipscomb was with his friends smoking marijuana the night he was shot.

Lipscomb began hallucinating—possibly because the marijuana was laced with a designer drug—and hit himself in the head with a frying pan before shooting himself, according to a search warrant affidavit.

The autopsy report listed the manner of Lipscomb's death as "undetermined."
