State Appeals Court Nixes San Anselmo Project: Report

SAN ANSELMO, CA — A state appeals court earlier this month ruled against San Anselmo property owners who are seeking to build a home against the wishes of a group of neighbors, The Marin Independent Journal reports.
The 1st District Court's June 10 ruling is the latest legal setback for Beth and Tim Sasan, who want to build a 3,328-square-foot home on a vacant 74,000-square-foot parcel near the Terra Linda border at 187 Sacramento Ave. according to the report.
The project initially got the blessings of the Marin County Planning Commission, which approved the project in a 6-1 vote in June 2017 according to the report.

But neighbors opposed to the project have since stopped it in its tracks.
The neighbors are opposed to the project on the grounds that its modern design didn’t fit the neighborhood’s character and that it would be too large compared to other neighborhood homes, the report said. They've argued that the project would depress neighborhood property values.

Opponents of the project successfully appealed the project to county’s Board of Supervisors in March of 2018, and the courts have upheld the Board's ruling twice, the report said.
The Sasans brought their case to the 1st District Court after an appeal in Marin County Superior Court was rejected according to the report.
