"Whereas, Public Contract Code section 22031(b)(1) authorizes a county road commissioner to utilize the procedures set forth in Article 25 (commencing with Section 20390) of Chapter 1 of the Public Contract Code, as an alternative to the procedures set forth in the Uniform Public Construction Cost Accounting Act, to perform emergency work; and
Whereas, Public Contract Code Section 20395(e) authorizes emergency road repair by purchasing the material and letting a contract for the work or by letting a contract covering both work and material without advertising for bids when the estimated cost of emergency work necessitated by the imminence or occurrence of a landslide, flood, storm damage, or other emergency exceeds twenty-five thousand dollars ($25,000) and the public interest and necessity demand immediate action to safeguard life, health, or property; and

Whereas, Sonoma County Code section 2-357 authorizes the Sonoma County road commissioner to utilize the procedures set forth in Article 25 (commencing with Section 20390) of Chapter 1 of the Public Contract Code, as an alternative to the procedures set forth in the Uniform Public Construction Cost Accounting Act; and
Whereas, Sonoma County Code section 2-28 transferred all duties of the road commissioner to the Director of Transportation and Public Works:
I hereby declare as the Director of Transportation and Public Works, that as an alternative to the procedures set forth in the Uniform Public Construction Cost Accounting Act, I intend to utilize the procedures set forth under Section 20395(e) of Public Contract Code in connection with the following work: Emergency Repairs of Memory Lane from Post Mile 10.05-10.07.
I further declare that the public interest and necessity demand immediate action to safeguard life, health, or property."
