LaPointe Doesn't Need to Submit New DNA Sample

The man who's murder conviction was overturned after decades still would have to submit a sample if new crime-scene DNA is found.

Richard LaPointe of Manchester does not have to submit a new DNA test sample to law enforcement authorities, a judge ruled Monday, according to the Hartford Courant.

LaPointe, incarcerated since 1989 after he was accused and later convicted of raping and killing his wife’s grandmother, may have to submit a DNA sample if prosecutors find crime-scene DNA evidence to compare it to, but not until then, the judge ruled.

The Connecticut Supreme Court recently affirmed a lower court, which said prosecutors had failed to disclose evidence that supported LaPointe’s alibi defense.
