Mistrial Declared for Simsbury Man Accused of Sexual Assault

The 23-year-old college student at a North Carolina university was accused of committing sexual assault on a semiconscious fellow student.

A North Carolina judge declared a mistrial Wednesday in the trial of Jeremy P. Jacob, 23, of Simsbury, charged with sexually assaulting a semi-conscious fellow student at Elon University, according to the Burington County Times-News.

Jacob is accused of having sex with a 19-year-old female student at the university in Elon, NC, without her consent on Jan. 18, 2014. A note to the judge from the jury foreman said that nine jurors believed Jacob was not guilty, while three wanted to convict him, and the eight-woman, four-man jury could not agree on a verdict, the report said. Prosecutors did not say Wednesday whether or not they would retry the case.

The woman testified that she was semi-conscious at the time and did not consent to sex. Jacob testified that she was alert and had consented, the newspaper reported.

The two had gone to an off-campus residence together after attending a campus fraternity party (Jacob was not a member of the fraternity), according to a report in the Greensboro News-Record.
