Despite Setback, Recall Petitions for Council Members Will Move Forward
Three Johns Creek citizens are spearheading recall petitions to have Council members Brad Raffensperger and Ivan Figueroa removed from office.
Johns Creek's voters have decided on a mayor and one council member - a run off election is set for Dec. 3 - but there may be more elections in the city's future.
There isΒ also a movement afoot to have council members Ivan Figueroa (Post 4) and Brad Raffensperger (Post 2) removed.
Several weeks ago aΒ trio of citizens, Greg Bock, Stephanie Endres and Wayne Carrel, had obtained recall applicationsΒ from City Hall and quickly gathered the 100 signatures for each council member to begin the recall process.
The forms were turned in to City Hall for processingΒ but they containedΒ a number of irregularities saidΒ City Clerk, Joanie Jones, and could not be used.
Jones saidΒ the state-issued formΒ requires that each signature collected include the signer'sΒ printed name and the date signed, some of that was missing on the forms and some of the printed names were not legibleΒ said Jones.Β
That has not deterred the group.
"We are going back out, It's going to be done," said Wayne Carrel who added that the three plan on picking up two new sets of forms at City Hall on FridayΒ and will begin knocking on doors soon afterwardsΒ to collect the required number of signatures.
Carrel said they have 15 days to return the forms and once that is done that will get the process started. The next step will be to collect 11,200 signatures (30 percent of the registered voters) within a 90-day period.
Following is a summary of the reasons for the recall application as stated on the original petitions which is not expect to change said Carrel.
1) Council Members violated City Charter and Oath of Office and has committed malfeasance when they caused the city to authorize the investigation at tax payers expense.
2) Β Council Members violated City Charter, Ordinances and Oath of Office and committed malfeasance and violated the open meetings act by voting to issue a press release challenging Mayor's and CM Stewart's statements criticizing the City Manager action onΒ Oct. 7.
