Aurora Wants Lawsuit Dismissed After Officers' Info Given To Gang Associate
City of Aurora and former records manager released private information to violent criminal behind bars.

AURORA, IL - The city of Aurora and its former records manager are requesting a federal judge dismiss a lawsuit from seven officers claiming their personal information was knowingly released to a gang-affiliated inmate. The incarcerated man is associated with a street gang and is serving an 88-year sentence at Menard Correctional Facility. He received the officers' addresses, family member names and more through a Freedom of Information Act request filed in 2015.
The city and former records manager Jo Anne Osberg indicated they would ask for dismissal with a status report filed earlier this month with the U.S. District Court.

A memorandum supporting the dismissal motion stated both of the suit's federal claims should be dismissed because there's "no substantive due process right to 'informational privacy.'"

The lawsuit alleges that the city and Osberg violated the officers’ right to privacy and caused emotional distress for them and their families. The city has refuted several claims to the lawsuit including claims that it didn't do enough to remedy the situation.
