Hearing On Demolition of Freund Home Delayed

A McHenry County judge has pushed back the hearing until the end of November.

MCHENRY COUNTY, IL — A McHenry County judge will give Joann Cunningham and Andrew Freund until Nov. 27 to respond to a city of Crystal Lake complaint seeking demolition of their home on Dole Avenue, the Daily Herald reports. The couple appeared before a McHenry County judge Wednesday, and is among 10 defendants listed in the case.

A foreclosure sale of the home is planned for Nov. 21, according to the article.

Freund, a recently disbarred attorney, said Wednesday he is considering filing a response, but doesn't have access to a computer for mandatory electronic filing. Costello agreed to waive that requirement for him.The status of the deteriorating, boarded up Crystal Lake house where authorities say AJ Freund was murdered by his parents will remain unchanged until at least late November.

"There's a lot of 'What ifs?' in the air about who buys it and what would be next in the demolition case," Jonathan Kaman, a Crystal Lake attorney, told the newspaper.

Andrew Freund and JoAnn Cunningham, 36, remain in custody and face multiple felony charges, including murder, aggravated battery and concealing a homicidal death, in connection with the April beating death of their 5-year-old son, A.J. Freund. The boy would have started kindergarten last month in Crystal Lake.
