Elgin Man To Serve 5 Years In Prison For Fatal DUI Crash In 2017
The man had a .118 BAC and was speeding in a 30-mph zone before the crash, which killed a passenger and severely injured another driver.
ELGIN, IL — An Elgin man was sentenced last week to serve more than five years in prison after he admitted to charges stemming from a fatal DUI crash in May 2017, according to Kane County prosecutors.
Joshua Hernandez, 23, pleaded guilty in September to aggravated DUI causing death and aggravated DUI causing great bodily harm, prosecutors said in a news release.
Twenty-five-year-old Stephanie Gordon was killed May 13, 2017, when Hernandez crashed his car into oncoming traffic while drunk, prosecutors said. The driver of the vehicle Hernandez hit was severely injured in the crash, which occurred on North State Street near Wing Street, the release states.

Police found a case of beer in Hernandez’s car after the crash, and the investigation showed he was driving at least 61 mph in a 30-mph zone, prosecutors said. His blood-alcohol concentration that day was .118, nearly 50 percent higher than the legal limit of 0.08, according to the release.

Christine Beyer, Kane County first assistant state’s attorney, said Hernandez has shown a “lack of remorse” for his role in the fatal DUI crash.
Hernandez must serve at least 85 percent of his sentence of five and a half years.
