Teen's Fatal Crash Case Should Be In Juvenile Court: Lawyer

The 17-year-old is accused of having meth in his system by prosecutors at the time of the accident.

NAPERVILLE, IL — An attorney representing a teen tried as an adult in connection to a fatal car accident is attempting to have his client's case moved to a juvenile court. The teen's Friday morning court appearance was stricken due to a motion filed by Attorney Bradley Harris who asked the judge to have the 17-year-old tried as a juvenile.

Harris and his client will appear at a Jan. 23 hearing before Judge Judge John Kinsella, according to DuPage County State's Attorney Office spokesman Paul Darrah. Prosecutors are accusing the teen of having methamphetamine in his system at the time of the September car crash that killed 21-year-old Calabria M. Taber of Maple Park, who was driving a motorcycle. The accident happened at the corner of 75th Street and Plainfield-Naperville Road.

Harris did express condolences to the victim and families involved in the accident.

"He's a senior in high school," Harris said, of the teen. "He's a great kid." He indicated that the video footage is key to their case, which Harris says, was not caused by drugs. The teen remains innocent unless proven otherwise in the court of law.

"Whether he's in adult court or juvenile court," Harris said, he's confident they'll prevail in the case, which he calls, "a long way from resolved."
