$5,000 Cash Bail Set For Hudson Man Charged With Vehicular Homicide

FRAMINGHAM - A Hudson man was arraigned in Framingham District Court on charges of motor vehicle homicide, while operating under the influence of alcohol, on Thursday.

Theriault was charged with operating a motor vehicle under the influence of alcohol (second offense) and motor vehicle homicide while operating under the influence of alcohol.

Judge David Cunis set bail at $5,000 cash and ordered the defendant not to drive, to not use alcohol or drugs, and to be subject to random screens, according to the Middlesex District Attorney’s office.

The Hudson man failed two sobriety tests, administered by Police, at the scene. At the Framingham Police Station, he registered 0.07 on the breathalyzer. The legal limit was 0.08.

The crash happened at 7:49 p.m. Theriault was arrested at 8:55 p.m.

Framingham Police responded to the 7:49 p.m. crash involving a vehicle and a pedestrian at Route 9 East, and on arrival officers discovered Stratton in the roadway, suffering from multiple injuries to his head and torso, said Lt. Cronin. Framingham Fire and EMS personnel also responded and determined that Stratton was deceased, according to Lt. Cronin.

Located at the scene was the involved vehicle, a 1999 Nissan Maxima, and the driver, Theriault, said Lt. Cronin.

Lt. Cronin told Patch reports had Statton in the crosswalk when struck.

Route 9 East was closed from Edgell Road to Oaks Road Wednesday night for more than 3 hours, while officers from Framingham and Mass State Police Collision Reconstruction Unit conducted an investigation.

This case is being investigated by the Framingham Police Department, the Massachusetts State Police, and the Middlesex District Attorney’s Office. These charges are allegations and the defendant is presumed innocent until proven guilty.

The prosecutor assigned to this case is Assistant District Attorney Nils Lundblad.

The next scheduled hearing in this case is Tuesday, February 9.
