Framingham Man Charged With Driving High On Marijuana With Kids In Car

Middlesex District Attorney's office: This is Framingham man's third time arrested and charged for driving while under influence of drugs.

A Framingham man is charged with driving his vehicle high on marijuana, with his three children in the Honda Pilot.

Luis Toledo, 34, of 29 Bridges Street in Framingham, was arraigned Thursday on charges of operating a motor vehicle under the influence of drugs, his third offense, according to the Middlesex District Attorney's office.

He was also arraigned on child endangerment while operating a motor vehicle under the influence, possession of a Class E substance (Xanax), unlicensed operation of a motor vehicle, and reckless operation of a motor vehicle, said a Middlesex DA's spokesperson.

Toledo was arrested by Sherborn Police on Wednesday night, after a motor vehicle stop on Washington Street. When Police stopped the Honda Pilot, they smelled marijuana and saw three children, under age 16 in the vehicle.

Natick District Court Judge Jennifer Stark set bail at $2,000 cash and ordered the defendant to not drive, to consume no drugs or alcohol, and to be subject to random screens, according to the Middlesex DA's office

Toledo has been convicted twice for drunken driving and has more than a dozen total convictions.

He is scheduled to be back in court on Thursday, April 7. The case is being prosecuted by Assistant District Attorney Dan Brunelli.

The charges are allegations and the defendant is presumed innocent until proven guilty.
