Suspect In Fatal Malden Shooting Caught: DA

Police also arrested a Chelsea man who they say helped Brian Butler flee the scene after shooting 30-year-old Erin Fitzgibbon.

MALDEN, MA — Police have arrested the suspect in a robbery and fatal shooting in Malden Tuesday morning. Brian Butler, 30, of Everett, was taken into custody in Ashland, the Middlesex District Attorney's office said.

Butler is accused of killing 30-year-old Erin Fitzgibbon, of Everett, inside a Fairmont Street home. Middlesex District Attorney Marian Ryan said Fitzgibbon was "in the wrong place at the wrong time."

Butler will face charges of murder, armed home invasion, armed assault with intent to murder, assault with a dangerous weapon, possession of a firearm and possession of a loaded firearm.

Police also arrested Cody DiGaetano, 24, of Chelsea. DiGaetano helped Butler flee the scene and drove him to Ashland, where Butler remained overnight, the DA's office said.

DiGaetano has been charged with accessory after the fact to an armed robbery and accessory after the fact to assault and battery with a dangerous weapon.

"We recognize that for [Fitzgibbon's] loved ones and for the public last night was a long night wondering about the whereabouts of Mr. Butler," Ryan said. "We believe that as a result of the media attention on this case an individual known to the persons involved in this incident was able to help move our investigation forward in locating Mr. Butler. We are grateful for everyone’s patience and vigilance in this case."
