Oakland County Deputy Accused Of Slapping Handcuffed Suspect
An Oakland County Sheriff's deputy has been charged with assault after he slapped a handcuffed suspect who kicked him, officials said.
OAKLAND COUNTY, MI — An Oakland County Sheriff's deputy has been charged with misconduct after detectives said he slapped a carjacking suspect while they were handcuffed, authorities said Friday.
The sheriff's office said deputy Kevin McNally, a 27-year veteran of the department, was arraigned Friday afternoon in 52-3 District Court in Rochester Hills on one count of misconduct in office and a second count of assault and battery.
McNally was given a $5,000 personal bail and termination proceedings have begun, the sheriff's office said.

“There is absolutely nothing acceptable about these actions by the soon to be former deputy,” Oakland County Sheriff Michael Bouchard said. “The behavior by this deputy was wrong and will never be tolerated. The public expects more from law enforcement and the actions did not live up to our expectations or standards.”
According to the Oakland County Sheriff's Office, McNally on Nov. 24 responded to WoodSpring Suites in Rochester Hills follow a 911 call related to a carjacking. The caller had said she was in her vehicle when she was attacked and the suspect had managed to get her out of the vehicle and drive off, police said.

Deputies said they were able to find the vehicle at a nearby Walmart.
McNally was the first Deputy on the scene and found the suspect incoherent and appearing to be under the influence of drugs or alcohol, police said. After the suspect was in handcuffs, police said she kicked McNally in the groin. In response, he slapped her across the face and became "increasingly aggressive with the subject," according to police.
An internal and criminal investigation began the next morning, police said. McNally was suspended the same day pending the results of the investigation, according to police.
The suspect, a 35-year-old Shelby Township woman, was previously charged with unlawful driving away an automobile, reckless driving, assault and battery and resisting arrest, police said. She is currently out on bail while further charges are pending the results of a blood test for alcohol and drugs, police said.
