Garcia was chosen by state senator Brian Stack to run on the Hudson Couty Democratic Organization's line to be one of two assemblymen for the 33rd district, which includes the entirety of Hoboken.

Garcia has said previously that he plans to keep his full time job as executive director of the Hoboken Housing Authority. According to the five plaintiffs bringing the suit, Garcia is ineligible because his salary is paid by federal funds.
