Erratic Driving Report Leads To Felony DWI Charge

The Pearl River man is also accused of resisting arrest.

PEARL RIVER, NY — Orangetown police were called about an erratic driver in the vicinity of Route 304 and Central Avenue at 7 p.m. Sunday. They say when they found Thomas J. Muthig of Central Avenue he exhibited behavior and signs indicating intoxication.

Police said when Muthig was ordered to get out of his 2016 Jeep, he tried to drive away and was stopped. He refused to get out of the car and resisted arrest. Taken into custody and to Orangetown police headquarters, he refused a breath test, police alleged.

Investigation revealed the 54-year-old was driving with a suspended license and had a conviction for driving while intoxicated within the past 10 years, police said.

He was charged with felony DWI, first-degree aggravated unlicensed operation of a motor vehicle, resisting arrest and obstructing governmental administration. He was released to a third person on $200 bail and is due in town court Nov. 19.
