Hep A-Related Class Action Suit Appealed By Bartaco
Patrons of the Port Chester restaurant were potentially exposed to the virus in October.
PORT CHESTER, NY — A southern Westchester County restaurant that faced a Hepatitis A outbreak is appealing a court order that would allow a class-action suit to proceed. Several patrons of bartaco who sued the establishment wanted the court to permit mail notifications to more than 3,000 people who got the hepatitis vaccine after the exposure last October.
The Port Chester restaurant's lawyers said the order should be overturned for reasons that include its voluntary payments to patrons took precedents over the mailings, the Journal News said.
County health officials said the exposure to the hepatitis A virus took place between Oct. 12 and 23. More than 3,000 people obtained recommended immune globulin shots, along with blood tests and other diagnostic procedures.

This week, health department officials announced that patrons who ate or drank at Winston in Mount Kisco may have been exposed to the virus between April 24 and May 1. On Tuesday, after interviews with restaurant staff., they extended the possible dates for exposure to include May 2-3.
