The instructor of an after school class working in the trails behind Hillside Elementary School is accusing a 13-year-old Children’s Village student of attacking her after she let him borrow her phone.

The student allegedly approached the teacher on the trail on May 16 and asked to borrow her cell phone. Police said a dispute occurred after the 13-year-old reportedly refused to return the phone. He is accused of throwing the phone to the ground causing its glass front to shatter and throwing rocks at the teacher, which caused her cuts to the elbow, swelling and substantial pain.

He was charged with assault and criminal mischief in the third degree, released back to Children’s Village and must return to family court on May 28.
