Man With Previous DWI Conviction Accused Of Drunken Driving

Police said the man sideswiped another car and kept going.

ELMSFORD, NY — A Yonkers man was accused of driving while drunk after a hit-and-run accident on Interstate 287 in the village of Elmsford.

The New York State Police said the preliminary investigation found that Florencio Diaz, 39, of Yonkers, was driving a 2010 Hyundai Tucson around 6 p.m. Saturday when he sideswiped a 2021 Jeep Wrangler.

According to authorities, Diaz kept going west and exited the Thruway where he crashed into a fence on Nepperham Avenue in Elmsford.

There were no reported injuries as a result of the accidents, police said.

Police said Diaz was intoxicated, and he was taken into custody.

After being processed at the Tarrytown barracks, he refused to give a breath sample.

Police said Diaz has a previous DWI conviction within the last 10 years and is required to operate a vehicle with an ignition interlock device.

As a result, he was charged with driving while intoxicated, a felony, and operating a motor vehicle with no ignition interlock device, a misdemeanor.

Diaz was turned over to a sober third party and released on appearance tickets returnable to the Village of Elmsford Court Jan. 20.
