Majority Of Fargo Businesses Pass Tobacco Compliance Checks
Several times a year, the tobacco prevention program partners with local law enforcement agencies to carry out tobacco compliance checks.
From the City of Fargo: Several times a year, the tobacco prevention program at Fargo Cass Public Health partners with local law enforcement agencies to carry out tobacco compliance checks in Fargo, West Fargo, and Cass County. The intent of the checks is to ensure tobacco retailers are not selling any tobacco products to minors.
Tobacco compliance checks were performed recently in Fargo on June 6, in West Fargo on June 18 and throughout Cass County on June 11. In Fargo, 41 of the 45 businesses passed compliance checks, resulting in a 91% success rate. In West Fargo, 14 businesses were checked and all passed, resulting in a 100% compliance rate. Across Cass County, 15 of the 17 businesses passed compliance checks, resulting in an 88% pass rate. Fargo Cass Public Health appreciates the cooperation of the business community across Fargo, West Fargo, and Cass County. Licensed tobacco retailers are encouraged to periodically review city ordinances and state laws related to sale of tobacco products and to include this important information in training for new employees.

- Penalties in Fargo and West Fargo are as follows:
- The first failure in a one-year time period – one-year probation*The second failure in a one-year time period – three-day suspension of the tobacco license
- The third failure in a one-year time period – ten-day suspension of the tobacco license

- A tobacco compliance failure in Cass County is considered an infraction and the penalty is imposed by the court.
