Sentenced Reduced for Trooper Resident in Mentally Disabled Sexual Assault Case
Testimony from a relative of the victim was determined to be 'unfairly prejudicial' and resulted in the judge's sentence reduction.

According to the Times Herald, Shawn Charles Stankina, 31, of Long Meadow Road in Trooper, had been re-sentenced in the case where he was charged with the sexual assault of a mentally disabled 19-year-old man.
The original sentence called for Stankina to serve 7 years and six months to 15 years in a state prison, followed by 20 years’ probation. With his reduced sentence, Stankina now faces five-to-10 years with 20 years’ probation.
The reduction was due to Stankina’s lawyer, Basil D. Beck III, and his argument that testimony given in August by a relative of the victim was “unfairly prejudicial,” as the relative was not qualified to include medical opinions in that testimony.

According to a previous report, Stankina had the victim in his presence during multiple incidents between 2008 and 2009.
Stankina was charged with rape of a mentally disabled person, involuntary deviate sexual intercourse with a person with a mental disability and indecent assault of a person with a mental disability.
