Nearby Cole Homeowners Also Sue Over Tax Assessments

Homeowners suing over damage to their houses from construction of Cole Middle School are also suing over property tax assessments they say should be zero.

The owners of three houses on Sarah’s Trace who have sued the town, the school department and a variety of others over damage they say was caused by construction of the new Cole Middle School are also suing the town tax assessor, arguing their assessments should be zero because of said damage.

Chris and Sue Lamendola, of 50 Sarah’s Trace; Tom Hogan and Cynthia Peloso, of 40 Sarah’s Trace; and Keith and Wendy Amelotte, of 35 Sarah’s Trace, filed lawsuits against town tax assessor Janice Peixinho in June.

According to Town Solicitor Peter Clarkin, the suit is pending in Kent County Superior Court.

“People appeal their taxes all the time,” said Clarkin. But, he acknowledged Monday, “nobody ever says their house is worth zero.”
