Texas Attorney General Sues KMCO Hours After Plant Fire
Texas AG Ken Paxton filed suit against KMCO on behalf of the TCEQ for violations of the Clean Air Act
AUSTIN — Texas Attorney General Ken Paxton, acting on behalf of the Texas Commission on Environmental Quality, filed a petition and Application for Injunctive Relief against KMCO, LLC in Crosby for violations of the Texas Clean Air Act.
The documents were filed in the District Court of Travis County, just hours after an explosion and fire at the plant injured two and killed one.
“I offer my condolences to the families who have suffered injury or loss and to the community impacted by the KMCO fire earlier today,” TCEQ Executive Director Toby Baker said in a press release. “I applaud the attorney general for acting swiftly on my requests to hold KMCO fully responsible.”

The State of Texas requests that the court grant the following relief as allowed by law: a permanent injunction, civil penalties and reasonable attorney fees, court costs, and investigative costs.
