Isiah Brown's Attorneys Request Audio Between Deputy, Dispatcher

The family of Isiah Brown, who remains at Mary Washington Hospital, has launched a GoFundMe to help pay expenses from his hospitalization.

SPOTSYLAVANIA COUNTY, VA — Attorneys for Isiah Brown, the 32-year-old man shot several times by a Spotsylvania County Sheriff’s deputy on April 21, filed a Freedom of Information Act request for the audio between a 911 dispatcher and the deputy as well as the identity of the deputy.

The Spotsylvania Sheriff’s Office released the audio of the call between Brown and the 911 dispatcher and the body-cam footage of the deputy soon after the shooting. Based on the 911 audio, Brown told the dispatcher that he did not have a gun and was unarmed.

Upon arriving at Brown's house in western Spotsylvania County in response to a 911 call, the deputy yelled at Brown to drop a gun and was heard in his body-cam footage saying that Brown had a gun pointed at his head.

The deputy, whose name has not been released, appeared to mistake a cordless telephone that Brown was using to speak with the 911 dispatcher for a gun.

Brown remains in critical condition in the intensive care unit at Mary Washington Hospital in Fredericksburg. He has undergone several surgeries since the shooting, including surgery last Friday to repair extensive damage to his intestines as a result of the multiple gunshot wounds he suffered.

In their FOIA request filed on Monday, Brown’s attorneys, from The Cochran Firm in Washington, D.C., asked for a full copy of the 911 dispatch center and the police dispatcher’s communications with the Spotsylvania Sheriff’s deputy during the hours of midnight and 3 a.m. on April 21 “before the subject shooting, including all communications sent to him in written word over the dispatch system to his squad car computer and any responses received from him by the 911 center or anyone else.”

The lawyers want to find out what the dispatcher communicated to the deputy, given that the 911 audio shows that Brown told the dispatcher that he was unarmed.

The lawyers, in the FOIA request, also are seeking the full name of the deputy who shot Brown, his personnel file and hiring date with the Spotsylvania Sheriff’s Office. Brown’s lawyers also requested the date he graduated from the academy and if he had been involved in any prior discharges of his weapon and use of force reports.

At the request of Spotsylvania Sheriff Roger Harris, the Virginia State Police began an investigation into the incident. Fredericksburg Commonwealth's Attorney LaBravia Jenkins has been appointed as special prosecutor and will decide what, if any, action will be taken against the unnamed deputy, who is white.

Brown's lawyers filed the FOIA request with the Spotsylvania Sheriff's Office and the office of LaBravia Jenkins.
