DeKalb County Sues Trump For Legal Fees In Election Fraud Lawsuit
DeKalb County is suing former President Donald Trump, his campaign and the Georgia Republican Party chairman over an election fraud lawsuit.

DEKALB COUNTY, GA — DeKalb County is suing former President Donald Trump for legal fees over a lawsuit questioning the legitimacy of the November presidential election in Georgia.
DeKalb County filed a motion Monday in the Fulton County Superior Court against Trump, his campaign and the Georgia Republican Party Chairman David Shafer, court documents show. Cobb County filed a similar motion on the same day, which DeKalb joined.
Trump and Shafer filed a lawsuit in the Fulton County Superior Court in December, alleging fraud and irregularities in the presidential election in Georgia. The lawsuit — which was withdrawn in Jan. 7, just one day after the Capitol siege and certification of President Joe Biden's victory — named DeKalb County's director of voter registration and elections, Erica Hamilton, and Cobb County's Janine Eveler as defendants.

Thirteen other county election department managers were also listed as defendants, as well as Georgia Secretary of State Brad Raffensperger. The Trump campaign also filed similar lawsuits that failed in other states.

"The Petition, which is one of seven lawsuits challenging Georgia’s presidential election results and among over 40 lawsuits filed nationwide, repeats unsubstantiated and frivolous claims of violations of state laws and regulations related to voter registration, absentee ballot processing, signature matching, and improper limits on the public and election monitors during the tabulation of votes and the recount," the motion reads.
Biden won DeKalb County with 83.12 percent of the vote, according to the Georgia Secretary of State's Office.
The county paid $6,104.50 in legal fees and court costs due to the election fraud lawsuit, since Hamilton was sued as a county employee. DeKalb County is seeking repayment for this spending, and claimed in its lawsuit that Trump, his campaign and Shafer included Hamilton's name "with no legal basis."
The motion said this was similar to Cobb County's lawsuit, which said Eveler was "improperly named as a defendant in this matter."
"Specifically, the Election Code authorizes four types of defendants in an election contest: (1) a person whose nomination or election is contested, (2) the person whose eligibility to seek nomination or office is contested, (3) the election superintendent who conducted the contested primary or election, and (4) the public officer who declared the votes for and against any question submitted to electors at an election," DeKalb's motion reads. "It is undisputed that Respondent Hamilton does not fall under any of these categories of defendants."
