Four Nabbed for Trespassing at Georgiaville Pond

Smithfield Police arrested three adults and a juvenile on July 29 for refusing to leave the island near the town beach. An arrest does not indicate a conviction.

Three adults and a juvenile face trespassing charges after Smithfield Police say they refused to leave the island near the town beach after multiple requests.

Patrol Ofc. Peter DiMarco responded to the pond on July 29 at about 3 p.m. and spoke with Brett Bursie, a supervisor with the Smithfield Recreation Department.

Bursie told DiMarco that he had seen the three male and one female swim out to the island and use a rope swing there to dive into the pond.

DiMarco reported that Bursie said he had identified himself as a rec department employee and told the four to leave the island.

"The four yelled 'no' and continued to swim and use the island rope," DiMarco quoted DiMarco as saying.

Smithfield Fire Department personnel responded with a boat and went out to the island to retrieve the four.

According to DiMarco, the four told him that since there were no signs on the island — which Bursie confirmed — they felt it "was public property."

DiMarco released the four after presenting the older three — Alexandria Birmingham, 20, of Cherry Hill Road, Johnston; Vincent DiStefano, 18, of Old Gas Road, Johnston; and Michael J. Murray, 22, of Connors Farm Road, Smithfield — with District Court summonses to appear at hearings on Aug. 13.
