Chignoli Auto Sales Sued By Bretz, Defective Brakes Alleged

JOLIET, IL —A Morris resident who bought a used car in Joliet from Chignoli Auto Sales at 1850 Essington Road in late 2019 has hired the law firm of Bretz, Flynn & Associates to sue Chignoli for more than $50,000 in damages.

Attorney Joseph Namikas is representing the plaintiff, Riley M. Jones. According to their lawsuit at the Will County Courthouse, Jones bought the 2015 Volkswagen Jetta from Chignoli Auto Sales on Nov. 3, 2019.

The lawsuit states that "in breach of its warranty to the plaintiff, the defendant sold the above referenced 2015 Volkswagen Jetta to the plaintiff when it knew or should have known that the vehicle was not in proper working condition."

According to Bretz, Flynn & Associates, their client was driving the Volkswagen Jetta on Nov. 9, 2019, six days after purchasing it at Chignoli Auto Sales, and "the brakes of said vehicle failed causing the vehicle to crash, greatly injuring the plaintiff."

The lawsuit alleges the Morris man's crash happened "as a direct and proximate result of the dangerous and defective condition of said vehicle."

Joliet Patch visited Chignoli Auto Sales on Thursday seeking comment about the lawsuit, but no one from Chignoli called back to comment.

The lawsuit states that Namikas' client "sustained severe and permanent injuries" as a result of his crash on Nov. 9, 2019.

"Because of the injuries, he was and will be prevented and hindered from attending to his usual duties and affairs," the lawsuit contends. "He has spent and will spend and become liable for large sums of money for hospital, medical and nursing care during his recovery."

The lawsuit seeks a judgment from a Will County jury in excess of $50,000 against Chignoli Auto Sales, plus legal costs for filing the lawsuit.
