UPDATED: Judge Denies Jones' Restraining Order Request

The county councilman, who will begin serving a five-month sentence in federal prison later this month, has asked the circuit court to block the council from removing him from office, according to The Capital.

Updated 11:49 p.m. Wednesday: Councilman Daryl Jones was denied the temporary restraining order he requested by an Anne Arundel County Circuit Court Judge Wednesday, according to The Capital.

Jones’ request would have kept the County Council from voting on legislation that could remove him from office.

Linda Schuett, Jones’ attorney, said in the Capital that removing the Severn councilman from his seat would cause “immediate, substantial and irreparable harm.”

Original article: With only 19 days until he is due to begin serving a five-month sentence in federal prison, Anne Arundel County Councilman Daryl Jones filed a temporary restraining order in an effort to stop attempts to remove him from the council, according to The Capital.

Jones' attorney told the Capital that the restraining order was filed Wednesday morning.

The move comes after councilmen John Grasso (R-2nd District) of Glen Burnie and Jamie Benoit (D-4th District) of Crownsville introduced legislation that would to serve five months for failing to file 35 tax returns between 2002-2007.

Both bills are scheduled to be voted on Jan. 17.

The motion could be ruled on as early as Wednesday afternoon, the Capital reported.
